Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Color Pour (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

2. Description of Service

Color Pour is a mobile puzzle game where players sort colored liquids between glasses. The App includes:

• Free puzzle levels
• Daily challenges
• Optional in-app purchases
• Optional subscriptions

3. User Eligibility

The App is rated 4+ and suitable for all ages. There are no age restrictions for using the basic features of the App. However, in-app purchases require permission from a parent or guardian if you are under 18 years of age.

4. Account and Device

Color Pour does not require account creation. Your game progress is stored locally on your device. You are responsible for:

• Maintaining the security of your device
• Backing up your device if you wish to preserve your progress
• Any activity that occurs through your device

5. In-App Purchases

5.1 Virtual Currency and Items

The App offers virtual currency (gems, coins) and virtual items that can be purchased with real money. These virtual items:

• Have no real-world monetary value
• Cannot be exchanged for real currency
• Are non-transferable between users or devices
• May be modified or discontinued at our discretion

5.2 Subscriptions

VIP subscriptions provide premium benefits for a recurring fee. Subscription details:

• Payment is charged to your Apple ID account at confirmation of purchase
• Subscription automatically renews unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your Apple ID Account Settings
• Any unused portion of a free trial period will be forfeited when you purchase a subscription

5.3 Refunds

All purchases are final. Refund requests must be submitted directly to Apple through their standard refund process. We do not have the ability to process refunds directly.

6. User Conduct

You agree not to:

• Modify, reverse engineer, or decompile the App
• Use cheats, exploits, or unauthorized third-party software
• Attempt to gain unauthorized access to our systems
• Use the App for any illegal purpose
• Interfere with or disrupt the App or servers

7. Intellectual Property

All content in the App, including but not limited to graphics, designs, text, sounds, and code, is owned by us or our licensors and is protected by copyright and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

8. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The App will be uninterrupted or error-free
• Defects will be corrected
• The App is free of viruses or harmful components

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data or progress
• Loss of virtual currency or items
• Unauthorized access to your device
• Any other matters relating to your use of the App

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

11. Modifications to the App

We reserve the right to modify, suspend, or discontinue the App or any part thereof at any time without notice. We may also modify game mechanics, virtual item values, or features at our discretion.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes through the App or by updating the “Last Updated” date. Your continued use of the App after changes constitutes acceptance of the new Terms.

13. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or us.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through informal negotiation. If informal resolution is not possible, disputes shall be resolved through binding arbitration.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede any prior agreements.
